SB 553 Training for workplace violence prevention

California SB 553 Workplace Violence Training

SB 553 Training requires employers to implement a workplace violence program for most California businesses open to the public, with ten or more employees working at a time. This bill was founded in the aftermath of a mass shooting incident at the Santa Clara Valley Transportation Authority in 2021.

Prevention Plan Requirements

  • Prohibit employee retaliation
  • Responding to reports of workplace violence
  • Employee workplace violence training and communication
  • Emergency response
  • Workplace violence hazard assessments
  • Other requirements, such as maintaining a violent incident log
  • Regulated by CAL OSHA

Labor Code 6401.9

  • Every covered employer is required to establish, implement, and maintain an effective workplace violence prevention plan. 
  • Plan must be in effect at all times and in all work areas.
  • The written plan may be incorporated as a stand-alone section in the written injury and illness prevention program required by section 3203 Title 8 of the California Code of Regulations.

Exemptions

  • Employees working remotely
  • Workplaces not open to the public
  • Healthcare Facilities (Although healthcare has its own Workplace Violence Prevention Program)
  • Law Enforcement and Jails/Prisons
